The world of UK visas can be quite overwhelming and confusing. At Coops Law, we understand it can be difficult for you to get all the info you need for UK Fiancé Visas in one place. That’s why we made this quick and simple video guide on UK Fiancé Visa.
When applying for a fiancé visa to help your wife or husband to join you in the UK, there are a number of steps which you both need to complete to make this possible. Currently, these steps only apply if you live outside of the European Union or Switzerland.
Either you or your fiancé must already be a British citizen with the right to permanently live in the UK. That person will have been born in the UK and hold a British passport. The visa can be applied for from within the UK or outside of it. The visa is required if the foreign applicant is to live in the UK for over six months.
If one member of the couple has already earned the right to settle in the UK, the person who is joining them must apply from outside of the UK. The person within this couple who has already earned the right to settle is known as the ‘sponsor’ and the person applying to join them is the ‘dependent’. The person who has already settled will have earned Indefinite Leave to Remain (ILR).
If you have entered the UK under a claim of asylum or humanitarian protection, which is successful, your partner can be reunited with you by applying for a fiancé visa. You must already be married or in a civil partnership, with that legal bond having been made before the asylum seeker entered the UK. Both parties must be planning to live permanently together in the UK.
One partner can complete the application forms for the other if they have difficulty doing this. There will also be a biometric testing requirement at the applicant’s nearest testing centre, where fingerprints and a photograph will be taken.
Documents to support your visa application need to be provided. In this case, it especially means providing evidence that you are in a genuine relationship together, that you live together, perhaps that you have children together and that you have financial arrangements together such as a joint bank account or a joint mortgage.
The fees for fiancé visas rose on 6th April 2017 to £1,464 per applicant. This fee will be converted to the applicant’s home country’s currency by the government for ease of understanding how much it will cost them.
This charge of £600 is an applicant’s contribution towards their own NHS healthcare.
