UK SPOUSE VISA REQUIREMENTS 2017

When applying for a spouse visa to help your wife or husband to join you in the UK, there are a number of steps which you both need to complete to make this possible. Currently, these steps only apply if you live outside of the European Union or Switzerland.

1) You must be a British citizen

Either you or your spouse must already be a British citizen with the right to permanently live in the UK. That person will have been born in the UK and hold a British passport. The visa can be applied for from within the UK or outside of it. The visa is required if the foreign applicant is to live in the UK for over six months.

Or, you must have settled in the UK

If one member of the couple has already earned the right to settle in the UK, the person who is joining them must apply from outside of the UK. The person within this couple who has already earned the right to settle is known as the ‘sponsor’ and the person applying to join them is the ‘dependent’. The person who has already settled will have earned Indefinite Leave to Remain (ILR).

Or, you must have been granted asylum or humanitarian protection by the UK

If you have entered the UK under a claim of asylum or humanitarian protection, which is successful, your partner can be reunited with you by applying for a spouse visa. You must already be married or in a civil partnership, with that legal bond having been made before the asylum seeker entered the UK. Both parties must be planning to live permanently together in the UK.

2) You must complete the relevant government application forms

  • If one partner within the couple is British, then a family of a settled person form must be completed
  • If one partner within the couple has obtained ILR, then it is also a family of a settled person form
  • If one partner within the couple is an asylum seeker/refugee or is protected under humanitarian protection, then the other partner needs a family reunion form

One partner can complete the application forms for the other if they have difficulty doing this. There will also be a biometric testing requirement at the applicant’s nearest testing centre, where fingerprints and a photograph will be taken.

 

3) Provide the correct documents

Documents to support your visa application need to be provided. In this case, it especially means providing evidence that you are in a genuine relationship together, that you live together, perhaps that you have children together and that you have financial arrangements together such as a joint bank account or a joint mortgage.

 

4) Here is a checklist of other documents you will need:

  • Current or previous passports
  • Proof of age
  • Evidence of being able to support yourselves financially, i.e. a salary of £18,600 or more
  • Proof of knowledge in the English language. There is a test for this
  • Tuberculosis test results: it is mandatory to have these carried out in your country of origin

5) Pay the application fees

The fees for spouse visas rose on 6th April 2017 to £1,464 per applicant. This fee will be converted to the applicant’s home country’s currency by the government for ease of understanding how much it will cost them.

 

6) The person applying may have to pay the NHS healthcare surcharge

This charge of £600 is an applicant’s contribution towards their own NHS healthcare.
